TAMMY SYTCH SENTENCED TO 17 YEARS IN PRISON

The Prosecutors brought in Mark Weinberg testify via Zoom.  He worked for 16 years testing blood and alcohol for FDLE labs.  After going through his background for the court, he was asked about a blood sample he was asked to analyze - Sytch's.  He did several analysis of the sample and found drugs and alcohol in the blood.

The defense got him to note he was testifying to the mathematical equation of the numbers given by Prosecutors, not that those numbers were correct.

He was asked if the active THC (compound in marijuana) he found in the blood would not be likely to cause impairment. He said it was a low volume and for most people, would not be impairment.

He was asked how quickly the active THC metabolizes in the body.  He said in about 4-8 hours for someone who usually doesn't consume it.  For someone who does it regularly, it would remain longer.  The sample would have been larger four hours before the blood sample analyzed.

That was it for Weinberg.

The State then called Joseph Hapner.  He is a local and was working for Ubereats, delivering food the night of Sytch's traffic incident.  He was traveling westbound on US-1 that evening.  He saw a white Mercedes that led to two cars in front of him stop because the Mercedes ran a red light.  The first vehicle was turning and had to slam on their brakes.  The second car had to stop.  There was almost a collision with the first car and the Mercedes.  This was about a 1/2 mile from where the incident took place.    Hapner then saw the crash.  The Mercedes had been traveling faster than the other cars in traffic.  He stopped and called the police and filled out a statement that night.

Sytch's defense pointed out he was not an expert on traffic accident reconstruction.  He could not state if the vehicle was traveling in excess of the speed limit.  He said it was at a high rate of speed.

Hapner was excused.

The State called an Officer Taylor.  He has been with the Ormond Police Department since 2019 and is a motor officer.  He discussed his training and experience, which is geared towards traffic enforcement.

The State asked about who executed the warrant for Tammy Sytch's blood.  The Daytona PD had to get involved due to jurisdiction.  They executed that warrant at 12:20 AM. She was read her Miranda rights by a Detective Garcia.  She stated she was unaware she was involved in a crash.  The last thing she remembered was drinking vodka while making leftover burritos in her kitchen.  She told him she was going to Wawa for gas and diet iced tea.

A search warrant for her medical records was executed.  They showed her blood was drawn an hour after the crash.  

A search warrant was executed for the white Mercedes.  There was an unsealed bottle of Grey Goose vodka on the passenger's side floorboard.  it still had liquid inside the bottle.

They began to show the Officer photos from the crash the night of the incident, which he took.   The Mercedes had disabling damage to its front end.  The Mercedes was Sytch's car.  A Black KIA was struck from behind and suffered major damage to the back.  That was driven by Julian Lasseter, who then crashed into the car in front of him, a Yukon.  Lasseter later passed away from the injuries suffered.

Officer Taylor and other authorities spoke to different witnesses who were consistent across the board as to what they say, the Mercedes run into Lasseter's car.

This case was Taylor's first case in DUI Manslaughter.  The defense tried to paint the picture that he did so alone and didn't call for any crime scene technicians to assist.  He admitted there are frequent crashes in that intersection.    All of the pieces of the cars were swept into a pile.  There was no way to tell whether the one tire mark at the scene was created by which car.  The officer was not aware whether there were any cameras at that intersection.  Taylor said he checked with the surrounding businesses.  The defense is trying to imply that perhaps Taylor didn't do his job to the best of his ability.  

The State redirected questions to Officer Taylor.  They were able to download data from the KIA driven from Lasseter but that not the Mercedes.  The brakes were applied on the KIA a half second before the crash.
