ALBERTO EL PATRON VS. COMBATE GLOBAL LAWSUIT DISMISSED

The lawsuit filed by former WWE and Impact Wrestling Champion Alberto El Patron against MMA promotion Combate Global before The United States District Court for the Southern District of New York was officially dismissed on 1/12 after a joint request by the two sides that the lawsuit be dismissed with prejudice (which would mean that a similar lawsuit could not be filed by Patron or Combate against each other) and that the two sides would each handle their own attorneys' fees, costs, and expense.

Judge Cathy Seibel signed off on the request that same day.

Such a move usually means the two parties came to some sort of agreement or settlement out of court, but there's no confirmation of that, nor would either party likely speak on the record about such a move.

In the lawsuit, Patron had alleged that Combate breached the contract for his 12/9/19 MMA fight against Tito Ortiz in Texas (which aired on PPV) by failing to pay him an owed $250,000 and by also not returning Patron's social media accounts to him after he allowed Combate access to them in order to promote the PPV.

Patron had asked the court for compensatory damages in the amount of $250,000.00 for Combate's alleged breach of contract, interest of at least $26,250.00 due and owing from and after December 31, 2019 "calculated as follows through April 15, 2021, and as determined by the Court for the days following April 15, 2021 up to the date judgment is rendered: 7% interest of $26,250", for Patron's costs and "reasonable" attorney's fees to be paid for by Combate, for Combate to return Patron's social media accounts to his control, damages determined at trial for compensation for Combate's "unlawful conversion of Plaintiffs’ social media accounts" and any other relief the court may rule is "just and proper."

An amended lawsuit was ruled as going forward in July 2022 after Combate Global's parent company was terminated as a defendant.    Combate had attempted to have the lawsuit dismissed, citing that the court lacks jurisdiction on the case and that it should be dismissed under federal rule of civil procedure, citing that since Combate's LLC has members in Florida and Patron is a citizen of Florida, the case should not be heard in federal court.    The Court ordered discovery into the situation and had previously announced they would make a ruling on the issue this February, after giving Patron's side the chance to argue against the motion to dismiss.   Obviously, all of that would now be moot.

As of this evening, there have been no postings to Patron's Instagram account in 144 weeks.
