PWInsider.com has confirmed that the U.S. District Court, District of New Jersey dismissed the lawsuit filed by wrestler Chris "Dickinson" Torre, who has appeared for New Japan Pro Wrestling, EVOLVE and GCW, among many other promotions, filed this past summer against ex-girlfriends Christina Kardooni (who wrestles as Christina Von Eerie) and McKaila Coulter on 12/19.
Kardooni and Coulter each filed motions back in September arguing that that the lawsuit never should have been filed in New Jersey as Dickinson resides in New York, Kardooni resides in Canada and Coulter resides in New England, therefore there was zero jurisdiction for a court in New Jersey to handle the case. In her motion to dismiss, Coulter noted that none of the instances she alleged about Torre occurred in New Jersey, none of her social media posts can be used to establish "Minimum Contacts" in New Jersey, the post don't reference "conduct" that occurred in New Jersey and that no efforts were made by Coulter to promote her social media posts in New Jersey. Coulter also noted that while Torre "assets Coulter aimed the social media posts at his employer", "a plain reading of the tweets shows that she did not." In Kardooni's motion, many of the same points were touched on. She also argued that her social media posts did not constitute "commercial" speech, so they would have no bearing on his professional wrestling career.
The presiding Judge, Susan D. Wigenton sided with the defendants after hearing Torres' argument against the dismissal motion and listening to a 20-Page report filed by another Judge on whether jurisdiction landed in New Jersey for the case, which advised that Torre did not bring enough evidence forth to prove that Jersey was the proper venue for the lawsuit and that the suit be dismissed.
Torre filed the lawsuit this past July, seeking damages for Kardooni and Coulter's alleged "blatant acts of defamation that wrongfully accuse Mr. Torre of abusive conduct." In the suit, Torre stated that he had relationships with Kardooni and Coulter at different times that ran their course. He alleged that he maintained "friendly" communications with each until they began disparaging him on social media after it became publicly known he had signed a contract with New Japan Pro Wrestling.
As noted previously, Kardooni posted allegations against Torre online this past April, alleging abusive behavior on his part during their relationship. Coulter later responded with her own allegations against Torre.
In dismissing the case, the court noted that the dismissal could mean "finding lack of personal jurisdiction may transfer the action to a court that has jurisdiction over the defendants" but as of that writing, that has not happened. It is entirely possible that is could still happen in the weeks ahead, should Torre choose to pursue the matter.
