UPDATES ON THE ALBERTO EL PATRON VS. COMBATE GLOBAL LAWSUIT

Here are some updates on the lawsuit filed by former WWE and Impact Wrestling Champion Alberto El Patron against MMA promotion Combate Global before The United States District Court for the Southern District of New York.  The Court had ruled on 7/26 that the lawsuit could move forward.

In his now amended 28-page lawsuit, Patron again alleged that Combate has breached his contract for his 12/9/19 MMA fight against Tito Ortiz in Texas, which aired on PPV by failing to pay him an owed $250,000 and by not returning Patron's social media accounts to him after he allowed Combate access in order to promote the PPV.

Patron asked the court for compensatory damages in the amount of $250,000.00 for their alleged breach of contract,  interest of at least $26,250.00 due and owing from and after December 31, 2019 "calculated as follows through April 15, 2021, and as determined by the Court for the days following April 15, 2021 up to the date judgment is rendered: 7% interest of $26,250", for Patron's costs and "reasonable" attorney's fees to be paid for by Combate, for Combate to return Patron's social media accounts to his control, damages determined at trial for compensation for Combate's "unlawful conversion of Plaintiffs’ social media accounts" and any other relief the court may rule is "just and proper."

The amended lawsuit was required after Combate Global's parent company was terminated as a defendant.  

Combate has since attempted to have the lawsuit dismissed, citing that the court lacks jurisdiction on the case and that it should be dismissed under federal rule of civil procedure, citing that since Combate's LLC has members in Florida and Patron is a citizen of Florida, the case should not be heard in federal court.  The Court has ordered discovery into the situation and will be making a ruling on the issue and will given Patron's side the chance to argue against the motion to dismiss. 

The court will issue a ruling on the matter by 2/6/23.
