Have you ever heard about the term DUI? It means Drunk and Impaired Driving and is most commonly met in Canada. You might know it by a different name, but all mean the same thing – the most commonly pardoned criminal conviction in Canada. DUI will get you charged of operating a motor vehicle after you have consumed alcohol or drugs and are still affected by this substance. You can even get charged for driving after you have consumed cough medicine. Section 235 of the Canadian Criminal Code presents this rule of law.

Although it might seem vague and abusive, Canada takes DUI arrests very seriously and it is almost impossible to have all charges dropped if you are charged with this felony. If your blood alcohol limit is of .08 you can generally get arrested for DUI. However, policemen have other options available if the subject is close to the limit, but not over it. Options can vary from province to province.

Canada takes all impaired cases to Court

If you are charged for a DUI in Canada do not expect to be found not guilty. This is highly unlikely, even if theoretical possible. Charges for a drunk driver vary from province to province:

- first offence: a $1000 fine and a 12-month driving prohibition,
- second offence: 30 days of jail and a 24-month driving prohibition
- third or subsequent offence: 120 days of jail and a 36-month driving prohibition.

Ways for getting a pardon or file destruction for a Drunk driving charge

If you want to get a pardon for your DUI charge, the first thing on the list should be to pay your fine. If there was no jail time involved, this contributes to your pardon.

A person who decides to apply for a DUI pardon should make sure that he or she is not involved in any traffic violations during the required waiting period, as these can be used against the same person during the process. If you meet all the criteria, you can seal your criminal record and DUI charges will be removed from you.

How to remove charges if you are convicted

Usually, the sentence that impaired drivers get in Courts is a fine and suspended license. If that happens, you will be able to apply for a pardon five years after your fine is paid, since license suspension is not considered a part of your sentence with the purpose of getting a pardon. DUI drivers are advised to pay their fines as soon as possible in order to avoid delays in getting the record cleared.

Repeat offenders can get heavier sentences, but those who pay their fines and afterwards follow traffic rules have nothing to worry about.
