2008 - A lawsuit was filed against against John Cena, World Wrestling Entertainment, Sony Music, Stephanie Music (WWE's music publishing company) and several other entities by members of hip hop group The M.O.P. that was first broken last week in the PWInsider.com Elite section during my audio hotline.  The lawsuit was filed in the United States District Court of New York earlier this month after communications between the two sides ended in mid-September.

The M.O.P. are upset that a sample of their song "Ante Up" was used in the "My Time is Now (John Cena Theme)" song on Cena's hip hop CD from a few years back and subsequently by World Wrestling Entertainment for Cena's ring entrance theme, on DVDs, CDs, PPV, and ringtones.

Two members of the group, Jamal Grinnage and Eric Murray are claiming that they turned down WWE's request to sample the song and then someone working for Next Level Publishing, a company owned by the third member of M.O.P, Daryl Pittman, then gave clearance when the person in question (who identified himself as the President of the company, but was in actuality just an office worker) did not have the rights to do so.  The lawsuit was filed after several letters back and forth to different entities involved resulted in an attorney for World Wrestling Entertainment claiming they had indeed correctly licensed the music to be sampled via Next Level.

Grinnage and Murray, claiming they own 66.6% of the rights to "Ante Up" are requesting damages, that they be ruled the proper owner of the song and that all DVDs, CDs, etc. using the sampled music be recalled and destroyed.

The suit was later dropped.

2008 - World Wrestling Entertainment scored a victory in their trademark infringement lawsuit against AWA Superstars promoter Dale Gagner for usage of the American Wrestling Association logo, trademark and for Gagner trading his company off as a continuation of the Verne Gagne company that WWE now owns the assets.

After several weeks of taking a WWE request for a summary judgment in the case based on Gagner's failure to follow instructions from the court and to hold up his end of the discovery period of the case, Judge Ann D. Montgomery sided with WWE, effectively ending several major points in the lawsuit.

WWE had claimed that by Gagner's use of the AWA trademark and letters, the company has been "irreparably harmed." noting the company "has lost its exclusive right and ability to control and/or determine the manner, appearance, timing, location, content and image of the AWA Marks, in which WWE has invested considerable resources to acquire, develop, and promote" while noting that Gagner's company has "unlawfully and unjustly" been able to benefit from properties that World Wrestling Entertainment legally owns.

Montgomery decided that WWE had proven that the trademarks to the AWA were owned by their company and that Gagner had done nothing to even argue his case for alleged ownership, noting he "introduced no evidence to create a genuine issue of fact" and that there would be a likelihood of confusion over the letters.  In the ruling, Gagner was permanently enjoined from ever using, exploiting or trading on the AWA name, trademarks, logo or any derivative, which means the death of his AWA independent promotion.

A big part of Montgomery's ruling was that Gagner had been sued and ordered not to use the AWA name during its time under Verne Gagne's ownership in the early 1990s, then went ahead and did it anyway after the original AWA shut down.  WWE's original complaint singled out Gagner as a "serial offender", noting that in April 1990, The Minneapolis Boxing & Wrestling Club (which then owned the AWA trademarks) filed a similar claim against Gagner. The courts ruled against Gagner in June 1990, enjoining he and his company from creating any claims that represented him as part of the original AWA promotion. WWE had alleged that Gagner has gone as far as to change the spelling of his name professionally to "Gagne" in an attempt to play off Verne Gagne's name when there is no relation between the two.  Gagner claimed to PWInsider.com at the time the lawsuit was filed that they were "distant relatives" although there is no factual proof of any relation to the best of my knowledge.

Gagner was also ordered to shut down and transfer the AWAStars.com website, which he used to promote his version of the AWA, to World Wrestling Entertainment.  A Myspace.com account opened under the AWA name was also ordered to be handed over to WWE.  Montgomery, in her decision, wrote, "The undisputed evidence shows that an evaluation of several factors weigh in finding that Gagner had a bad faith intent to profit from the AWA [trade] marks in registering and using domain names that incorporate those marks."  Gagner was told he had three days to transfer the sites.

Gagner's website featured images of Verne Gagne, The Vachons, Nick Bockwinkel, The Crusher, and The Bruiser, and the tag line "Since 1959, the Major League of Professional Wrestling." The company's title lineage dates back to Pat O'Connor and Verne Gagne in the 1950s as well. The website features a number of upcoming dates from independent promotions around the country, which are using the AWA letters and logo, having paid an "entrance fee" to join the promotion.  After he lawsuit was filed, Gagne created T-shirts to sell to play off of the lawsuit.  At the same time, a number of the independent companies (but not all) that had opted to sign on with the AWA, dropped the recognition for fear of being added to the lawsuit or WWE pursuing them legally.

Incredibly, Gagner's websites are still up and running as of this writing, which would be eight days after the ruling and five days after Gagner's shut down and transfer deadline.

Montgomery noted in her ruling that she was not going to find that Gagne had intended Civil Contempt by trading on the AWA trademarks, but that if he did not adhere to her ruling, noted she was withholding the option of changing her mind at the request of WWE.

Gagner was ordered to file a letter with the United States District Court of Minnesota by 10/31 acknowledging its decision and that he had done everything that was ordered of him.

2010 - Dragon Gate USA held their first Internet PPV in Fall River, MA.  Stu Carapola filed the following live report:

-Sami Callihan won an eight man Fray match, making Silas Young tap out to a horse collar for the win. Really good match, fast paced and hard hitting without getting overly fancy.

-Brandon Webb and Matt Raven defeated Scott Reed and Guy Alexander in a short but solid tag team match.

-Vinny Marsiglio defeated Ryan Waters with a Canadian Destroyer. This was really disjointed and should have opened the preshow instead of closing it.

-Bobby Cruise came out before the PPV went live and talked about his trips to Japan on Dragon Gate tours, and put over the locker room and promised that it won't be a show you'll want to miss.

-CIMA came out with Ricochet and announced him as the newest member of Warriors, and said they will get one more new member tonight. This led right into...

-Chuck Taylor won a Four Way Freestyle that also included Ricochet, Arik Cannon, and Johnny Gargano when he pinned Cannon with an Offal Waffle. Total spotfest with all four guys killing each other with move after move. CIMA came out after the match and asked Taylor to join Warriors, but Taylor declined and pulled himself out of the draft. Gargano begged CIMA to pick him, but CIMA and Ricochet just walked off.

-A promo from Jon Moxley played on the video wall, but we got no audio in the building so nobody knew what he was saying.

-Homicide defeated Rich Swann following a lariat. Homicide came out with BxB Hulk so I guess he's the new member of Hulk's group. Not a very good match, and it seemed like Swann was intimidated by wrestling Homicide on iPPV.

-Following the match, Austin Aries came out and cut a promo saying that wrestling is in a downslide because wrestling doesn't respect itself, and he believes in doing things with honor. He put over Swann for his match and offered to be his mentor, and told him to stay at ringside and watch his match.

-Masato Yoshino defeated Austin Aries with his twisty choke thing. After the match, Rich Swann went to help Aries up, but let go and dropped Aries and walked off laughing.

-We got another video promo (we heard it this time) with Gargano again begging CIMA to bring him into Warriors. This was followed by a video package setting up the Jacobs-Moxley match.

-Up next was the I Quit Match with Jacobs and Moxley. Moxley cut a quick promo saying that he was out here alone because It's between him and Jacobs. Jacobs took him by surprise by diving on him off the balcony to start the match. This match was just brutal, Jimmy bled a gusher and at one point Moxley tied his hands behind his back and repeatedly rammed a steel spike into his face. Jacobs got free and got ahold of spike and started grinding it into Moxley's groin until Moxley quit. Jimmy cut a postmatch promo saying that this was the last time for a long time you're going to see him bleeding and diving off balconies because he's now focused on winning a major singles title for the first time, and his road to the Open The Freedom Gate Title begins tonight.

-Sami Callihan cut a video promo saying that if he's not drafted, there's going to be trouble.

INTERMISSION

-Brodie Lee and Akebono defeated the Osirian Portal. This was mostly comedy and Brodie and Akebono spent most of the match fighting each other to set up their match tomorrow night in Rahway.

-Homicide cut a backstage promo officially announcing that he joined World 1 and then was attacked by Jon Moxley, who challenged him for tomorrow night in Rahway on behalf of Kamikaze USA.

-YAMATO and Akira Tozawa defeated CIMA,and Genki Horiguchi in an awesome tag team match, and afterwards Johnny Gargano came out and asked CIMA to choose him to be in Warriors. Before CIMA could answer, Gargano superkicked him and then Rick Swann and Chuck Taylor ran out and they attacked CIMA 3 on 1 as Gargano said he never wanted to join Warriors and didn't need CIMA's approval. As they left, CIMA introduced the newest member of Warriors, Brodie Lee. Brodie, Ricochet and CIMA chased Gargano's team out through the crowd and out of the building.

-We got a video package hyping the main event, and then Aries offered to team with Warriors tomorrow night against Robin. (Gargano's group)

-BxB Hulk defeated SHINGO is an absolutely amazing, hard fought main event. YAMATO attacked Hulk after the match, but Yoshino chased him off and said he'd take care of him tomorrow in Rahway. Yoshino thanked the crowd for coming, and that's a wrap.

2010 - WWE broadcast Smackdown.  Richard Trionfo filed the following TV report:

On Sunday night, the Undertaker was buried alive. Will we ever see the Dead Man again? A door opens . . .

We are live on tape from Milwaukee, Wisconsin and your announcers are Matt ‘Shotz Brewery’ Striker, Todd ‘Schlemiel’ Grisham, and Michael ‘The Bud Selig of announcers’ Cole.

Kane and Paul Bearer are at the gravesite for the Undertaker and Kane says that the saga is over. He has proven his dominance over the Undertaker for the final time. He says that his brother is never coming back. It is because he buried Taker. Kane starts to walk to the ring and he says that there is going to be talk in the coming days and months about plots and conspiracy theories. The Undertaker is gone because of one person and one person only. That person is him.

Now that his brother is truly one with the dark side. Now that he is condemned to an eternity of agony, he wants everyone to thank him. He wants everyone to thank him for removing the false hope that he provided to each and everyone’s meaningless lives. He says that he knows that everyone is clinging to a futile shred of hope that the Undertaker will return. He says that will never happen. The Dead Man is six feet underground. While he is rotting and decomposing, like his legacy, Kane says that he is the champion.

Kane says that he is the pulse of everyone. He is the heartbeat of every insect in the audience desperate for a patriarch. He says that he is the devil’s favorite demon. Kane says that the time for mourning is now so he demands that everyone stand up and bow your heads to observe a moment of silence for the man you will never see again. His fallen and so to be forever forgotten brother, the Undertaker.

The moment of silence is interrupted by Alberto Del Rio, who drives into the arena. Kane cannot believe what Alberto did and he talks to Paul about it.

Alberto says that this is a tragedy and he is not talking about the Undertaker. The only tragedy is that he never had a chance at the World Title. He tells Kane that he is handsome, rich, and powerful. He says that the only funeral we are going to have is for the World Title.

Alberto will be in the match, but he will be facing Edge and Rey Mysterio. Teddy tells Alberto to prove that he is the top commodity on Smackdown. Alberto says that he will prove it.

2011 - In a weird story, EMLL cancelled their usual Sunday show at Arena Coliseo in Guadalajara due to a request of someone not named because of the Pan American Games that are currently taking place. Pato Soria who along with being Shocker's father has been working as the promoter in GDL of late said that the closing ceremonies are taking place at the same time as the show and the request was made so it was accepted. Another twist to this story is that Soria said that Tuesday is his last day as promoter which happens to coincide with the rumors going around that Apolo Dantes is coming back to his old job as promoter of GDL.

2012 - Hulk Hogan settled his lawsuit against Bubba the Love Sponge over a sex tape featuring Hogan and Bubba's then-wife Heather Clem which was taken without Hogan's knowledge and later leaked online.

The following statement by Bubba was issued as part of the settlement:

October 29,2012
Re: Public Apology to Hulk Hogan (Terry Bollea) and Retraction of Statements

After further investigation, I am now convinced that Hulk Hogan was unaware of the presence of the recording device in my bedroom. I am convinced he had no knowledge that he was being taped. Additionally, I am certain that he had no role in the release of the video.

It is my belief that Terry is not involved, and has not ever been involved, in trying to release the video, or exploit it, or otherwise gain from the video's release in any way.

Regrettably, when Hulk filed the lawsuit against me, I instinctively went on the offensive. The things that I said about him and his children were not true. I was wrong and I am deeply sorry for my reaction, and for the additional pain that it caused Hulk and his children on top of the pain that they already were feeling from having learned that Terry was taped without his knowledge, and the public release of the video.

I am committed to helping Hulk and his attorneys find whoever is responsible for the release of the tape and holding them accountable to the fullest extent of the law.

*

Hogan and Bubba, who prior to the lawsuit were best friends, have not reconciled their friendship as of this writing.

2012 - John Cena, on behalf of WWE, announced during Raw that the company had raised one million dollars for the Susan G. Komen For the Cure to aid in the research and fight against breast cancer.  The announcement was the finale of a month long awareness campaign that saw WWE promote awareness with special merchandise, promotional videos and utilizing breast cancer awareness colors during their event and online outlets, among other promotional tools.

2012 - WWE broadcast Raw.  Richard Trionfo filed the following TV report:

he show starts with footage from Hell in a Cell, when referee Brad Maddox gave Ryback a low blow to help CM Punk win the match and retain the title. We then see a photo of Ryback giving CM Punk the marching muscle buster on top of the cell.

We are live from Charlotte, North Carolina and your announcers are Jim ‘Did someone mention what happened in the Notre Dame/Oklahoma game during Hell in a Cell’ Ross and Michael ‘Where are the Tony Chimmel guys’ Cole.

CM Punk does what he has done for the last three hundred forty-four days as he holds the WWE Championship. CM Punk’s ribs are bandaged and he limps to the ring while Paul Heyman holds the title over his head.

Punk says that they all thought that he was unbeatable. You all said it couldn’t be done. You all thought . . . you all knew that he would be just another victim left in a trail of bodies by the monster Ryback. Punk says that he proved you all wrong.

Punk tells Jim Ross that he was wrong. He tells Cole that he was wrong. He tells the Spanish announcers that they were wrong. Punk goes around the ring and points out how everyone was wrong. He proved everyone wrong. For 344 days, he has proven everyone wrong. Since day one he has been proving everyone wrong. He has defeated every one of their heroes. He has survived everything that they have thrown at him.

Rey thought that he could fly at his expense, but he caught him out of the sky and put him to sleep. The Apex Predator of Raw said that he would send him to the hospital but he proved that the Anaconda Vice was stronger than the Viper.

There is the resident Superman in John Cena, but time and time again, he has beaten John and showed him what kryptonite is.

As far as Ryback is concerned, he is not in the conversation.

Punk wants to talk about his monumental victory, which should be applauded. The victory has been shrouded in controversy. Punk has been blamed for getting a referee to put his hands on Ryback. Punk says that he had nothing to do with it.

Punk says that he was on Ryback’s shoulders and he thought he was going to get Shellshock, but he was shocked. The only thing that he is guilty of is taking advantage of a situation caused by a rogue official.

Punk says that the official’s name is Brad Maddox. Punk says that Brad was hired by former General Manager AJ Lee, so that shows that he is incompetent. He wonders if Brad was returning the favor for costing him in a match a few months ago. Punk says that he had nothing to do with it.

Punk says that you can hate him, but the list goes on and on. Triple H . . . Vince McMahon. The entire TitanTower machine has tried to erase him from the record books, but he is unerasable. He can proudly say that now he looks at Ryback in a completely different way. Ryback is in his rear view mirror because he is done. There is no rematch.

Mick Foley’s music plays and he makes his way to the ring and Punk says that he will not be interrupted.

Punk says that it is the homeless man who has been displaced by the storms in the northeast.

Foley likes how Punk makes light of the situation. Foley says that 24 hours ago, he was left splattered on top of the cell after Shellshock by Ryback.

Punk wants to know why Mick is here. The last time Mick was on television, he got his ass kicked by Punk. He thinks that Foley is out here to embarrass him.

Foley says that he did not come out in . . . Charlottte, North Carolina to embarrass him. Punk did enough to embarrass himself inside the cell.

Punk wants to know if Foley is here to judge him.
